Welcome to Claim N Billing (“Company”, “we”, “our”, “us”). These Terms of Service (“Terms”) govern your access to and use of our website, services, and offerings. By using our website or engaging our services, you agree to these Terms.

By accessing claimnbilling.com or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of our website and services.

2. Services Provided

Claim N Billing provides professional billing and administrative support services, including but not limited to:

  • Medical billing and coding
  • Claim submissions and follow-ups
  • Eligibility verification
  • Accounts receivable management
  • Insurance correspondence
  • Revenue cycle management

All services are delivered according to industry standards and within the scope of the agreements made with each client.

3. Client Responsibilities

To ensure accurate and timely processing, clients agree to:

  • Provide accurate, complete, and timely information
  • Supply necessary documentation required for billing or claims
  • Maintain compliance with HIPAA and federal regulations in their own operations
  • Notify Claim N Billing of any changes related to insurance contracts, provider credentials, or practice details

We are not responsible for delays or errors caused by incomplete or inaccurate information provided by the client.

4. HIPAA Compliance & Confidentiality

Because Claim N Billing handles documents and data related to medical billing, we maintain strict compliance with the Health Insurance Portability and Accountability Act (HIPAA).

We agree to:

  • Protect all Protected Health Information (PHI)
  • Use PHI only for permitted billing and operational purposes
  • Maintain administrative, physical, and technical safeguards
  • Sign Business Associate Agreements (BAAs) when applicable

Clients must also follow HIPAA regulations within their own practices.

5. Fees, Payments & Billing Terms

Service fees, billing schedules, and payment methods are defined in the contract or service agreement between Claim N Billing and the client.

General terms include:

  • Payments must be made according to the invoicing schedule
  • Late payments may result in service delays or additional fees
  • Any third-party costs (clearinghouses, software, etc.) are invoiced separately unless otherwise agreed

We reserve the right to modify pricing with advance notice.

6. Service Availability & Limitations

While we make every effort to ensure uninterrupted service, we do not guarantee:

  • 100% uptime
  • That all claims will be approved or paid
  • That external systems (insurance portals, EHRs, clearinghouses) will function without issues

We are not responsible for delays caused by:

  • Insurance carriers
  • System outages
  • Incomplete or inaccurate information provided by the client
  • Regulatory changes

7. Intellectual Property

All content on claimnbilling.com—including text, images, graphics, website design, and branding—is owned by Claim N Billing and protected by copyright laws.

You may not copy, reproduce, or use our content without written permission.

8. Prohibited Activities

When using our website or services, you agree not to:

  • Engage in unauthorized access or data breaches
  • Use our services for unlawful activities
  • Upload malicious code, viruses, or harmful content
  • Misrepresent information about your practice, patients, or claims
  • Attempt to reverse-engineer or copy any service processes

Violation of these rules may result in immediate termination of services.

9. Limitation of Liability

To the fullest extent permitted by law, Claim N Billing is not liable for:

  • Lost revenue due to insurance denials
  • Delays caused by third-party systems
  • Errors resulting from incorrect information provided by clients
  • Consequential or incidental damages

Our liability, if any, will not exceed the amount paid by the client for the services in question.

10. Termination of Services

Either party may terminate the service agreement with written notice as defined in the contract.

We reserve the right to terminate service immediately if:

  • HIPAA violations occur
  • Fraudulent activity is suspected
  • Payment obligations are not met
  • Terms of Service are violated

Upon termination, all outstanding fees must be paid.

11. Modifications to Terms

We may update or modify these Terms at any time to reflect:

  • Regulatory changes
  • Industry standards
  • Service updates

Updates will be posted with a revised effective date and become effective upon publication.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
